Agreement:
The photographer grants the licensee the non-exclusive, non-transferable and non-assignable use of a final gallery of 50 images and one 30 second video (the imagery described above) photographed and filmed by Nicole Nason from date of purchase for the purpose of social, web, and press media usage. Two non-agency surf talent will surf, swim, and sail for the project.
Payment:
The amount of $1000 USD, is to be paid in two parts, an initial retainer of 500 to start the project and 500 remaining balance due by March 31st, 2024. Two models shall receive and keep their suits worn for the project as part of this agreement.
Provisions:
The photographer retains all copyrights attached to this imagery as well as any that may not be detailed in this agreement. Selling and/or redistribution of these images is forbidden. Licensee is allowed to crop and edit these images as needed to suit their purposes.
Indemnity:
The Licensee indemnifies and holds harmless Nicole Nason against all claims, liability damages, costs, and expenses stemming from a breach of this agreement, the use of the image, your failure to abide by any restriction regarding the use of an image, or any claim by a third party related to the use of the image.
Warranty and Liability:
This image is provided “as is” with no warranty regarding the suitability of the image for any purpose. The artist is not liable to the client or any person or entity for damages, costs or losses stemming from any usage of this image.
In case of bad weather, natural disaster, or other unforeseen circumstance, client will be contacted as soon as possible to discuss and determine alternative options.
